Terms of Use
These terms are an agreement between you and Sarat Penumarthy (“we”, “us”), the maker of SVIFA. By installing or using the app you agree to them. If you do not agree, please do not use the app.
1. What SVIFA is
SVIFA is an iOS app that turns your activity photos and GPX route files into a 3D map flyby. Some features need an account; others work in guest mode. Our Privacy Policy explains how your data is handled and forms part of these terms.
2. Beta software
Builds distributed through TestFlight are pre-release software. They may be incomplete, change without notice, stop working when a build expires, or lose data. Please keep your own copies of any photos or GPX files you care about. Apple’s TestFlight terms also apply to beta builds.
3. Your account
- You must be at least 13 years old to create an account.
- Keep your password private. You are responsible for activity under your account.
- Give us a real email address that you control; we use it for verification codes and account recovery.
- Guest mode has limits (currently up to three experiences, no export, sync or sharing). Guest data lives only on your device and is deleted if you leave guest mode or uninstall the app.
- You can delete your account at any time from Profile → Delete Account. This is permanent.
4. Your content
Your photos, routes and experiences remain yours. We claim no ownership of them. You give us only the limited permission needed to run the features you use — for example, sending photo coordinates to a routing service when you have enabled Route finding. You are responsible for having the right to use any content you add, including photos of other people.
5. Acceptable use
Do not use SVIFA to:
- break the law or infringe anyone’s rights;
- upload or share content that is abusive, obscene, or harmful;
- probe, overload or interfere with our servers, or bypass usage limits;
- reverse-engineer the app, except where the law allows it;
- track or reveal another person’s location without their permission.
6. Maps and routing
Maps, place names and calculated routes come from third-party services (Mapbox, OpenRouteService, Apple) and may be inaccurate, out of date, or unavailable. Routes shown in the app are an approximation for visual playback. They are not navigation advice. Never rely on them for safety, and always follow signs, conditions and local rules when you are out.
7. Subscriptions and pricing
SVIFA is free to use during beta. If paid tiers are introduced later, their prices and terms will be shown in the app before you buy, and purchases will be handled by Apple through the App Store and subject to Apple’s terms.
8. Our intellectual property
The SVIFA name, logo, app design and code belong to us or our licensors. These terms do not give you any right to use them other than to run the app. Open-source components and photographs used in the app are credited in Settings → About → Acknowledgements.
9. Changes and ending the service
We may update the app, add or remove features, or stop offering SVIFA. We may suspend or close accounts that break these terms. If we make material changes to these terms we will update the date above and, where appropriate, tell you in the app.
10. Disclaimers
SVIFA is provided “as is” and “as available”. To the extent permitted by law we make no promises that it will be error-free, uninterrupted, or fit for any particular purpose.
11. Liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Otherwise, to the extent permitted by law, we are not liable for indirect or consequential loss, lost data, or lost profits arising from your use of the app, and our total liability to you is limited to the amount you paid us in the 12 months before the claim (which, during beta, is nothing).
12. Law and disputes
These terms are governed by the laws of England and Wales. If you are a consumer living elsewhere, you keep the protection of mandatory laws in your own country. Disputes will be handled by the courts of England and Wales, or your local courts where consumer law requires.
